The Board of County Commissioners of Washington County, Idaho, does hereby meet this 18th day of August, 2025.

IN THE MATTER OF ROLL CALL)

Donna White, Clerk, called roll call: Gordon Wilkerson, present; Jim Harberd, present; and Nate Marvin, present.

Jim Harberd opened the meeting, and Gordon Wilkerson led the Pledge of Allegiance. Nate Marvin gave the invocation.

IN THE MATTER OF CORRESPONDENCE/MEETINGS AND REPORTS)

Correspondence received by the Board was reviewed and disseminated as required.

Nate Marvin stated he attended the Area III Agency on Aging meeting last week. Marvin provided an update from the meeting.

The Board reviewed a July 28, 2025, Local Highway Technical Assistance Quarterly Progress Report. The Board also reviewed an August 11, 2025, letter from ICRMP (Idaho Counties Risk Management Program) regarding Claim Number C-25-01044-23531.

Nate Marvin moved, seconded by Gordon Wilkerson, to approve a Certificate of Residency for Danner Morris. Motion carried.

Nate Marvin moved, seconded by Gordon Wilkerson, to approve and sign the Professional Services Agreement with Atlas Surveying. Motion carried.

Robert Peterson, Information Technology Director, discussed an Apprentice Program through ITS (Idaho Information Technology Services) at no cost to the County. The funding for the program is through the State and Local Cybersecurity Grant Program.

Jim Harberd moved, seconded by Gordon Wilkerson, to approve Apprentice Program through ITS. Motion carried.

IN THE MATTER OF MINUTES)

The minutes of the Board not heretofore approved of August 11, 2025, were approved as written.

IN THE MATTER OF ROAD & BRIDGE/SOLID WASTE)

Jerod Odoms, Road and Bridge/Solid Waste Supervisor, met with the Board.

Nate Marvin moved, seconded by Gordon Wilkerson, to have the Chairman sign the Idaho Transportation Department Local Professional Services Agreement #97333 regarding Cove Road Bridge. Motion carried.

Odoms informed the Board chip seal has been completed. Odoms stated they were able to complete 25 miles of chip seal. Odoms provided a department update to the Board.

IN THE MATTER OF BUILDING INSPECTOR)

Danny Roark, Building Inspector, met with the Board. Roark informed the Board two permits were issued last week, one set of plans were dropped off for review, and eight inspections were done. There was discussion regarding applications that would need to go before the Planning and Zoning Commission.

IN THE MATTER OF AMBULANCE)

Jim Harberd moved, seconded by Gordon Wilkerson, to recess as the Board of Washington County Commissioners and convene as the Board of the Weiser Ambulance District. Motion carried unanimous.

Alan Foster, Ambulance District Director, met with the Board. Order No. 25-44 for payroll expenses in the amount of $26,846.73 and Order No. 25-45 for general expenses in the amount of $11,468.31 was presented to the Board for review. Foster discussed the possibility of hiring outside counsel as a Tax Attorney to assist with an override levy.

Marvin stated he felt it would need to be discussed with Prosecuting Attorney, True Pearce.

Foster provided an update on staffing at the district. Foster reported that Idaho EMS (Emergency Medical Services) EM-Save Grant contacted him last week regarding purchase of radio equipment with the grant funding up to $40,000.00. Foster further stated that he will be contacting the LOR Foundation regarding additional grant funding.

Nate Marvin moved, seconded by Gordon Wilkerson, to approve Order No. 25-44 for payroll expenses in the amount of $26,846.73. Motion carried.

Jim Harberd moved, seconded by Gordon Wilkerson, to recess as the Board of the Weiser Ambulance District and reconvene as Board of Washington County Commissioners. Motion carried unanimous.

IN THE MATTER OF PROSECUTING ATTORNEY)

True Pearce, Prosecuting Attorney, met with the Board.

Alan Foster discussed the possibility of securing legal counsel for the purpose of pursuing an override levy.

Pearce stated that the Ambulance District does not need his permission to seek legal counsel.

Jim Harberd moved, seconded by Nate Marvin, to go into executive session at 10:32 a.m. in accordance with I.C. 74-206(1) (a & b) to consider hiring a public officer, employee, staff member or individual agent. This paragraph does not apply to filling a vacancy in an elective office, (b) to consider the evaluation, dismissal or disciplining of, or to hear complaints or charges brought against, a public officer, employee, staff member or individual agent, or public school student; and (f) to communicate with legal counsel for the public agency to discuss the legal ramifications of and legal options for pending litigation, or controversies not yet being litigated but imminently likely to be litigated. The mere presence of legal counsel at an executive session does not satisfy this requirement. Motion carried unanimous. Gordon Wilkerson, Aye; Jim Harberd, Aye; Nate Marvin, Aye.

Jim Harberd stated they were out of executive session at 11:03 a.m. “No final actions or decisions were made in executive session. We will now return to our regular agenda.”

IN THE MATTER OF EMPLOYEE UNEMPLOYMENT DECISION)

Based on advice from legal counsel, no action was taken. PLANNING AND ZONING ADMINISTRATOR INTERVIEWS)

Gordon Wilkerson moved, seconded by Jim Harberd, to go into executive session at 11:30 a.m. in accordance with I.C. 74-206(1) (a & b) to consider hiring a public officer, employee, staff member or individual agent. This paragraph does not apply to filling a vacancy in an elective office, (b) to consider the evaluation, dismissal or disciplining of, or to hear complaints or charges brought against, a public officer, employee, staff member or individual agent, or public school student.

Jim Harberd stated they were out of executive session at 1:18 p.m. “No final actions or decisions were made in executive session. We will now return to the regular agenda.”

Motion by Jim Harberd, seconded by Gordon Wilkerson, and unanimously carried to recess at 1:19 p.m. until August 21, 2025, at 8:45 a.m.
